PLEASE READ THE FOLLOWING CONDITIONS OF SALE BEFORE PLACING AN ORDER ON THIS WEBSITE. THIS WEBSITE IS OPERATED BY SHARLENE LTD. SHARLENE LTD RESERVES THE RIGHT, AT ANY TIME, TO MODIFY THESE CONDITIONS OF SALE.

1. Orders

By submitting an order form this confirms you have read and agree to be bound by our Conditions of Sale, you are making an offer to purchase the Product(s), which you have specified in your shopping basket. All orders are subject to acceptance by SHARLENE LTD. Within 1 working day of our receipt of your order, you will receive a confirmation of your order by email, along with your order reference number. This number should be retained for future reference. Any acceptance of your order by SHARLENE LTD is subject to these conditions of sale and to the availability of stock.

SHARLENE LTD reserves the right to withdraw any Products from the Website Shop and may, in its sole discretion, refuse to process an order for any reason at any time. Without prejudice to your statutory rights as a consumer, SHARLENE LTD will not be liable to you or a third party by reason of SHARLENE LTD withdrawing any Product or refusing to process any order.

2. Price and Payment

All prices are quoted in £ sterling. Delivery charges will apply. Except in the case of manifest error, the prices payable for Products that you order are as set out on the Website at the time at which you place your order.

Payment may be made via our Paypal account using a wide selection of credit and debit cards. You confirm that the credit/debit card which is being used is yours.  All credit/debit card holders are subject to validation checks and authorisation by the card issuer.

Payment may also be made by Cheque or Bank Transfer.  Please note that SHARLENE LTD require cleared funds prior to dispatch of items and 24 hour delivery requests will require a CHAPS, Credit or Debit Card payment on day of order.

Goods paid for in this manner will be subject to a 10 day lead and processing time to allow for cleared funds to be available and dispatch of ordered goods.

3. Description of Products

The Products depicted in the Website Shop are as seen. The reproduction of colours and styles are as accurate as photographic and image processing will allow. SHARLENE LTD does not accept responsibility for slight variances in colour and style.

4. Cancellation and Returns

No Quibbles Guarantee

Our 'no quibbles’ guarantee means that if, for any reason, you are unhappy with your purchase, i.e. the item you have ordered is defective or you have simply changed your mind then, provided that it is in its original condition, and the item has not been personalised, you can return it to us for prompt replacement or refund within 30 days of delivery.

Returns

If you want to return an item, simply return the items to:

Indicating which item(s) and the number of items to be returned, your reason for returning the item, and whether you are seeking a replacement or refund. We also ask you to give us a daytime contact telephone number.

Defective Items

If you return an item because of an error on our part, or because it is defective, we will happily refund your costs in returning it to us. The item(s) must be returned in the condition in which you received it within 30 days of delivery.

Returned Item(s) Lost in Transit

We cannot be held responsible for packages lost in transit: as you are responsible for returning the items to us, we recommend sending the packages by Recorded/Special Delivery.

Refunds and Replacements

For item(s) returned to us within 30 days of delivery in accordance with these terms and conditions, a refund or replacement will be processed by SHARLENE LTD within 14 working days of receipt of the returned items.

A refund will be made in the same form of payment that was used to make the initial purchase.

If you would like a Replacement, this will be to your original product specification as detailed on your original order.

5. Delivery

SHARLENE LTD will deliver the Products ordered by you to the address, which you give for delivery when you make your order. You may specify a delivery address which is different from your invoice address, if, for example, you would like SHARLENE LTD to deliver the Products directly to a friend, a relative, or to your place of work.

Order to delivery normally takes up to 7 working days for UK deliveries unless Express Delivery  is selected, up to 7 working days for European Union deliveries, and up to 10 working days for deliveries to the Rest of the World. At peak times, such as Christmas, deliveries may take a day or two longer.

For UK orders (only), there is an Express Delivery option - orders will be delivered within 5 working days. Delivery charges are applicable as follows:-

£4.95 on all deliveries up to £50.00

£5.65 on all deliveries of £50.00 - £100.00

Free delivery on orders of £100.00 or over


Please note that Sharlene accepts no liability for local taxes that may be required at point of destination (on overseas orders) and the customer shall be liable in full for any VAT payable at point of destination.

If you do not receive Products ordered by you within 28 days of the date on which you ordered them, SHARLENE LTD shall have no liability to you unless you notify SHARLENE LTD by email at enquiries@discountfootballstore.co.uk of the problem within 40 days of the date on which you ordered the Products.

Unless you have cancelled your order prior to delivery, you will become the owner of the Products once they have been delivered to you. In any case, after delivery they will be held at your own risk and SHARLENE LTD will not be liable for any loss, damage or destruction to the Products except insofar as it arises from an inherent defect in any of the Products.

6. Liability

Unless otherwise agreed in writing, SHARLENE LTD's maximum liability to you arising by reason of or in connection with the supply of the Products to you shall be limited to the amount paid by you in respect of the Products in question (“Payment Amount”). SHARLENE LTD shall not in any event be liable to you for:

  • (i) any direct loss in excess of the payment amount; or
  • (ii) any breakages or damage or loss caused by a third party in transit
  • (iii) any loss of profits, business or anticipated savings or loss of or corruption to data or any other indirect loss or consequential loss whatsoever even if it has been advised of the possibility of such loss.

Nothing in these conditions of sale shall exclude or limit the liability of SHARLENE LTD for death or personal injury due to its negligence or for its fraud. This does not affect your statutory rights as a consumer.

8. Force Majeure

SHARLENE LTD shall have no liability to you for any delay or failure to deliver the Products to the extent that such delay or failure to deliver arises from causes beyond the reasonable control of SHARLENE LTD including, but not limited to, fire, floods, acts of God, acts or regulations of any governmental or supranational authority, war, riot, strike, lock-out and industrial disputes.

9. Waiver

No waiver by us shall be construed as a waiver of any rights or remedies, or any subsequent breach of any provision of these Conditions of Sale.

10. Entire Agreement

These Conditions of Sale, together with the Returns Policy, current Product prices, delivery details and contact details on this Website, set out the whole of the agreement between you and SHARLENE LTD. SHARLENE LTD's employees or agents are not authorised to make any representations concerning the Products unless confirmed in writing by SHARLENE LTD. You confirm that you do not rely on, and waive any claims for breach of, any such representations, which are not so confirmed.

11. Third Party Rights

A person who is not a party to the contract governed by these Conditions of Sale has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision of these Conditions of Sale.

12. Governing Law

These Terms and Conditions shall be exclusively governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.

  • "Conditions of Sale" means these terms and conditions of sale;
  • "Product" means any products displayed for purchase on this Website through the Website Shop;
  • "Returns Policy" the policy governing the cancellation of your order and return of Products, as displayed on the Website;
  • "Terms of Use" means the terms governing your use of this Website displayed on the Website;
  • "Website Shop" means the SHARLENE LTD store through which the Products are purchased by you;
  • "Website" means the website located at www.discountfootballstore.co.uk
  • "working day" means a day other than a Saturday or Sunday on which clearing banks are normally open for business in the City of London;
  • "you" means a user of this Website.
